Rule 19: OBLIGATION OF THE MANUFACTURER, FACTORY DISTRIBUTOR, AUTHORIZED DISTRIBUTOR OR DEALERSHIP OR SELLER TO PROVIDE TRANSPORTATION IN CASE OF REPAIR OF NEW MOTOR VEHICLES

19.1 -  Always when the repair of a new motor vehicle exceeds a period greater than five (5) calendar days, not including Sunday, except if the vehicle is dedicated to public transportation or commercial exploitation or that the time to repair it is due to an Act of Nature or Force Majeure, the consumer may demand the use of a similar motor vehicle while it is in repair form the seller, the authorized distributor, the dealership, the factory distributor and the manufacturer or its representative, who are jointly obligated to provide the consumer a similar motor vehicle while it is in repair. If it has no available units, the dealership or authorized service agent will be responsible for providing the consumer a similar vehicle to the one in repair and is found in optimum conditions mechanically, in safety and operationally. The dealership or authorized service agent must pay the cost of the vehicle rented.

This obligation will be extended only within the basic warranty of three (3) years or 36,000 miles grated by this Regulation. The responsibility to provide transportation or pay for it will be the responsibility of the entity that requests the service.

19.2 - The computation of five (5) calendar days will not be considered interrupted when the repair results ineffective and for the same reason or defect and the vehicle returns to the repair shop before seven (7) calendar days.

19.3 - The consumer will diligently care for the vehicle borrowed and will take all reasonable care to protect the rights of the owner. Every claim against the consumer regarding the vehicle borrowed will be cleared up at the Department always and when the consumer has presented a lawsuit before the Department in which the entity responsible for providing the rented or leased vehicle is party and that said lawsuit is relating to the actions for which the vehicle was rented or leased.

19.4 -  The consumer will return the rented unit as soon as he/she is notified that his/her vehicle is duly repaired and verifies that the vehicle is ready for use. The consumer will return the unit rented the next business day after the notification.
